甲方因承建科威特國家博物館新館工程，需要在雇主提供的工程設(shè)計圖紙基礎(chǔ)上做符合現(xiàn)場施工需要的深化設(shè)計；乙方系具有工程設(shè)計資質(zhì)和大型工程設(shè)計經(jīng)驗的專業(yè)設(shè)計院，愿意接受甲方委托承擔(dān)合同所約定的工程施工圖深化設(shè)計。雙方經(jīng)過平等協(xié)商，在真實、自愿的基礎(chǔ)上，根據(jù)相關(guān)法律法規(guī)的規(guī)定，達(dá)成如下協(xié)議，雙方共同恪守。

Party A, for the construction of the new National Museum of Kuwait, needs to deepen the design based on the engineering design drawings provided by the Employer to meet the needs of on-site construction; Party B, a professional design institute with engineering design qualifications and experience in large-scale engineering design, is willing to accept Party A's entrustment to undertake the deepening of the design of the engineering drawings as prescribed in this contract. The parties shall, through equal consultation on a true and voluntary basis and in accordance with the provisions of relevant laws and regulations, reach the following agreement for the parties’ joint observance thereof.

第二條 對深化設(shè)計圖的要求

Article 2 Requirements for deepening design drawings

本合同設(shè)計項目的內(nèi)容：名稱、規(guī)模、階段、投資及設(shè)計費等見如下規(guī)定：

Article 2 The contents of the design project of this contract: name, scale, stage, investment and design fee, etc. are shown in the following provisions:

1、根據(jù)甲方的設(shè)計要求繪制本工程深化設(shè)計圖。

1、Drawing the deepening design drawings of the project pursuant to Party A’s’ design requirements.

2、乙方所繪制的深化設(shè)計圖，包括相關(guān)說明、圖紙目錄、平面定位圖、標(biāo)準(zhǔn)施工圖、索引圖和圖表編號等。

2. The deepened design drawings drawn by Party B include relevant instructions, drawing catalogue, plan positioning diagram, standard construction drawings, index drawings and chart numbers.

第四條 乙方應(yīng)向甲方交付的設(shè)計文件

Article 4 Design documents delivered by Party B ?to Party A

深化設(shè)計圖紙?zhí)峤唬好颗鷪D紙乙方需提交 套送審白圖、 套硫酸圖和 套藍(lán)圖、完整文字資料一套。所有圖紙均須提供電子版圖紙(光盤)，且上述圖紙版權(quán)歸甲方所有。

圖紙和文字資料提交具體時間由甲乙雙方協(xié)商確定。

Submission of deepening design drawings: Party B shall, for each batch of drawings, submit a set of white drawings, a set of sulphuric acid drawings and a set of blueprints and a complete set of textual information. All drawings should be provided with electronic version of drawings (CD-ROM), and the copyright of the above drawings falls within Party A.

The specific time for submission of drawings and text information shall be determined by Party A and B through consultation.

6.1.3如果甲方要求乙方在合同規(guī)定時間之前交付設(shè)計資料及文件，如果乙方能夠做到，甲方應(yīng)根據(jù)乙方提前投入的工作量，向乙方支付趕工費。

6.1.3 Provided that Party A requires Party B to deliver the design information and documents before the time specified in the Contract and Party B is able to do so, Party A shall pay Party B’s acceleration fees on its prior workload.

6.1.4甲方應(yīng)保護(hù)乙方的設(shè)計方案、文件、資料圖紙、數(shù)據(jù)、計算軟件和專利技術(shù)。否則，乙方有權(quán)向甲方提出索賠。

6.1.4 Party A shall protect Party B's design proposals, documents, information drawings, data, calculation software and patented technology, otherwise Party B shall have the right to claim against Party A thereon.

6.1.5甲方要求乙方派專人留駐施工現(xiàn)場進(jìn)行配合與解決有關(guān)技術(shù)問題時，雙方應(yīng)另行簽訂補(bǔ)充協(xié)議或技術(shù)咨詢服務(wù)合同。

6.1.5 Where Party A requests Party B to dispatch the assigned personnel to stay at the construction site to cooperate and solve related technical problems, the parties shall conclude a separate supplementary agreement or technical consulting service contract.

6.1.6如果甲方要求乙方交付設(shè)計資料及文件的份數(shù)超過合同約定的份數(shù)，乙方另收工本費。

6.1.6 Where copies of the design information and documents required by Party A more than the prescription herein, Party B will charge an additional cost.
